NTC Fines Telcos P100K Daily Over Mobile Internet

The National Telecommunications Commission (NTC), the government agency that regulates phone, internet, and broadcast services in the Philippines, has begun charging the country's three largest mobile operators a fine of ₱100,000 per day over what it calls poor mobile broadband service in Metro Manila, and the industry's main lobby group says the penalties were imposed before the companies had a real chance to answer the findings.635 The fines, which took effect September 25, apply to Globe Telecom, Smart Communications, and DITO Telecommunity, and were delivered through show-cause orders — legal notices that require a company to explain why it should not be penalized.4153 The Philippine Chamber of Telecommunication Operators (PCTO), whose members include Globe, PLDT-Smart, DITO, Converge ICT Solutions, Bayantel, and PT&T, said in a statement on Wednesday that the fines were charged "upon receipt of the Show Cause Orders, before operators were given adequate notice and a meaningful opportunity to be heard, respond to, and contest the NTC's findings."635

The same regulator is moving on a second front. The NTC is drafting a memorandum circular — a set of binding rules issued by an agency without needing a new law — that would require anyone importing, selling, leasing, or distributing used and refurbished mobile phones, tablets, modems, and routers to hold a Refurbished Mobile Phone Dealer Permit (RMPDP) from the commission.730 Only devices that carry original NTC type approval, are untampered, boxed under an authorized brand, and sold with a one-year repair-or-replacement warranty would be allowed on the market.1142 The proposal was presented at a public hearing at the NTC's central office on September 23, and the commission says its aim is to stop the sale of stolen and illegally acquired phones and the trade in tampered or defective units.71147

The proposal raises a question the sector will have to answer: if carriers can block sites unilaterally, who reviews those decisions, and what recourse do wrongly blocked publishers have? PLDT frames the ask as a matter of speed and says it wants clearer safeguards and policies to define its role, preferring "some level of empowerment" granted by law or a designated government entity.3132 The read for the sector: content moderation is shifting from a platform problem to a carrier problem, and the rules governing it are being written now. A ₱33-billion bid to run the country's air navigation services

ComClark Network and Technology Corp., led by Dennis Anthony H. Uy, partnered with JG Summit Infrastructure Holdings Corp. and Asia's Emerging Dragon Corp. on an unsolicited proposal to design, construct, finance, operate, and maintain air navigation services nationwide.3738 The scope is broad: air traffic management, communications, navigation and surveillance equipment, aeronautical information, flight calibration, airfield lighting, civil aviation training, meteorological services support, and search and rescue.37 The Public-Private Partnership Center deemed the proposal complete and endorsed it to the Civil Aviation Authority of the Philippines on September 23.3738

An unsolicited proposal means the consortium pitched the project itself rather than responding to a government tender, which typically triggers a process in which other firms can submit competing offers. Air navigation services are the systems that keep aircraft separated and guided — infrastructure most travelers never see but that every flight depends on. The read for the sector: if the project proceeds, a private consortium would take over a function long held by the state, and the connectivity and technology firms involved would extend their reach into aviation infrastructure.

Power becomes the constraint on data-center growth

Meralco PowerGen Corp. and VITRO REIT, Inc. signed a memorandum of understanding to study data centers integrated with renewable energy and power generation facilities.3440 The joint feasibility study will cover potential sites, power generation capacity, renewable resources, connectivity requirements, data center specifications, and commercial structures.34 VITRO is a subsidiary of PLDT's ePLDT Inc. and is preparing for a public listing, while MGEN is behind what could become the world's largest integrated solar and battery storage facility.52

Silence lets the regulator's numbers stand alone.

For second-hand device dealers: treat the RMPDP as a coming cost of doing business and start documenting sourcing now. The rules will require proof of legitimate origin and NTC type approval, so dealers who can show clean supply chains will be positioned to qualify while informal sellers exit.

For consumer-facing messaging on refurbished phones: lead with the warranty, not the permit.
